Framezz Terms and Conditions

Welcome to Framezz, a platform that connects filmmakers ("Filmers") with Event Organizers to create professional aftermovies. By accessing and using Framezz, you agree to comply with the following terms and conditions ("Agreement"). Please read them carefully. Framezz is part of Vierbijdrie (kvk: 78463130).

1. Definitions

• Platform: Framezz, the online service connecting Filmers with Event Organizers.

• Filmer: A registered individual or entity offering videography services through Framezz.

• Event Organizer: A person or entity seeking videography services via Framezz for an event.

• Aftermovie: A video project created by the Filmer to capture the highlights of an event.

2. Platform Use

2.1 Eligibility: You must be at least 18 years of age to create an account on Framezz.

2.2 Account Registration: All users must provide accurate, complete information during account registration. Users are responsible for maintaining the confidentiality of their login credentials.

3. Responsibilities of Filmers and Event Organizers

3.1 Filmer Obligations: Filmers agree to deliver the aftermovie as per the agreed terms with the Event Organizer. The Filmer is responsible for all legal and copyright obligations, including obtaining any required permissions or releases.

3.2 Event Organizer Obligations: Event Organizers must provide accurate event details and make timely payments for the services. They will also provide any necessary support or access needed by the Filmer to capture footage at the event.

4. Booking and Payment

4.1 Payment Process: Event Organizers are required to pay the full amount for the aftermovie service upfront at the time of booking via Framezz’s secure payment platform. Once payment is confirmed, the Filmer’s contact details will be shared with the Event Organizer.

4.2 Platform Commission: Framezz charges a 10% commission on all transactions, deducted from the payment made by the Event Organizer.

4.3 Release of Funds: After the event is completed and the aftermovie is delivered, Framezz will release the payment to the Filmer minus the 10% commission.

5. Cancellation Policy

5.1 For Event Organizers: Event Organizers can cancel their booking for free up to 14 days (2 weeks) before the scheduled event. If the cancellation occurs within 14 days of the event, no refund will be issued.

5.2 For Filmers: Filmers must notify the Event Organizer and Framezz immediately if they are unable to fulfill the booking. Repeated cancellations may result in penalties, including suspension or termination of the Filmer's account.

6. Intellectual Property

6.1 Ownership of Content: All video footage remains the intellectual property of the Filmer unless otherwise agreed in writing. Event Organizers receive a non-exclusive license to use the aftermovie for personal or promotional purposes as outlined in the contract between both parties.

6.2 Usage Rights: Any commercial use of the aftermovie, including further distribution or editing beyond the initial scope, must be negotiated separately with the Filmer.

7. Liability and Dispute Resolution

7.1 Platform Liability: Framezz acts solely as a marketplace connecting Filmers and Event Organizers. We are not liable for any disputes, breaches of contract, or issues related to the quality of services or payments between the two parties.

7.2 Dispute Resolution: In case of disputes between Filmers and Event Organizers, both parties are encouraged to resolve the matter directly. Framezz may assist with mediation but does not guarantee resolution.

8. Termination of Account

8.1 Termination by Framezz: Framezz reserves the right to suspend or terminate any user’s account for violations of these Terms and Conditions, including misuse of the platform, failure to deliver services, or repeated cancellations.

9. Privacy and Data Sharing

9.1 Privacy Policy: Framezz is committed to protecting your privacy. Please review our Privacy Policy for information on how we collect, use, and store your personal data.

9.2 Data Sharing: Event Organizers' contact details will only be shared with the Filmer once payment is confirmed. Framezz will not share personal information with third parties without your consent.

10. Amendments to Terms

Framezz reserves the right to modify or update these Terms and Conditions at any time. Any changes will be effective upon posting to the Platform, and continued use of Framezz signifies acceptance of the updated terms.
